BOMA/Chicago, along with a coalition of business groups, has filed a lawsuit against the Chicago Board of Election Commissioners. The suit was filed on Friday in Cook County Circuit Court and seeks an injunction to prevent the Commissioners from certifying and placing a proposed Transfer Tax Referendum question on the March 2024 Primary Election ballot. According to BOMA/Chicago and other plaintiffs, this three-part question violates both the Illinois Municipal Code and Illinois Constitution.
The lawsuit is part of efforts by opponents of Chicago Mayor Brandon Johnson’s proposal to impose a transfer tax. The proposal would result in higher tax rates for portions of property valued above $1 million while providing tax cuts for properties valued under that amount. It is estimated that this tax would generate at least $100 million annually which would be used by the city to address homelessness.
This legal action highlights concerns over potential violations within current legislation rather than specific organizations such as Connect or Connect LA/Texas.
