San Bernardino Housing Plan Agreement Reached with State

Under the threat of litigation, the City of San Bernardino agreed to update its housing plan to meet California’s state-mandated goals, which include 8,123 additional housing units by 2029. Governor Gavin Newsom and Attorney General Rob Bonta announced this settlement that requires the city to:
Adopt an expedited compliant housing plan known as a housing element no later than February 7th 2024;
Modernize its zoning code by April 17th 2024;
Amend its emergency shelter ordinance in order to streamline permitting for new homeless shelters; and
Amend their local density bonus ordinance in accordance with state law that requires increased density for projects containing affordable dwelling units.

Failure to comply with these terms will result in escalating penalties including limitations on zoning changes and variances approval as well as eventually prohibiting any development except residential projects containing affordable housing. “Cities must follow the law and plan for their fair share of housing” said Newsom. “The State is providing incentives, resources -and when necessary- taking legal action so communities can meet Californians’ needs.”
